BABY EQUIPMENT RENTAL AGREEMENT & LIABILITY WAIVER

FEES & IMPORTANT INFORMATION
Delivery & Collection Fee:
The delivery and collection fee is based on the rental location and will be confirmed with the customer before the reservation is finalized.

Cleaning Fee:
A USD $50 cleaning fee may be charged if equipment is returned with excessive stains, food, sand, bodily fluids, smoke odor, or other conditions requiring cleaning beyond normal rental preparation.

Damage, Loss, or Non-Return:
Customers may be responsible for reasonable repair or replacement costs for equipment that is lost, stolen, intentionally damaged, negligently damaged, or returned with missing parts or accessories. Failure to return equipment may result in a charge for the full replacement cost of the equipment.

1. RENTAL AGREEMENT
I acknowledge that I am renting baby and/or children's equipment from The Baby Butler TCI. I agree to use all rented equipment safely, responsibly, and only for its intended purpose.
I understand that I am responsible for ensuring that each item is appropriate for the child's age, height, weight, and developmental stage. I agree to follow all manufacturer instructions, safety warnings, and usage recommendations.

2. EQUIPMENT CONDITION
I acknowledge that I have had the opportunity to inspect the equipment upon delivery or collection.
If I discover any damage, defect, missing part, malfunction, or safety concern, I agree to stop using the equipment immediately and contact The Baby Butler TCI.
I will not attempt to repair, modify, or alter any rented equipment without prior authorization from The Baby Butler TCI.

3. ADULT SUPERVISION
I understand that children must be appropriately supervised whenever they are using rented equipment.
I accept responsibility for the safety and supervision of any child using equipment rented under this agreement.

4. CAR SEATS & CHILD PASSENGER SAFETY EQUIPMENT
If I rent a car seat, booster seat, or other child passenger safety equipment, I understand that I am responsible for ensuring that the equipment is appropriate for the child's age, height, and weight and is properly secured and used.
Unless professional installation is expressly provided in writing, The Baby Butler TCI does not guarantee installation of a car seat into a customer's vehicle.
Any assistance provided with positioning or setup does not relieve the customer, parent, guardian, driver, or vehicle owner of the responsibility to review the manufacturer's instructions and confirm that the seat is properly installed before transporting a child.

5. ASSUMPTION OF RISK
I understand that the use of baby and children's equipment may involve risks, particularly when equipment is improperly installed, incorrectly used, damaged, modified, used outside manufacturer recommendations, or used without appropriate adult supervision.
To the extent permitted by applicable law, I voluntarily accept the risks associated with the use of the rented equipment.

6. LIABILITY WAIVER
To the fullest extent permitted by applicable law, I agree that The Baby Butler TCI, including its owners, employees, representatives, contractors, and agents, shall not be held responsible for injury, accident, loss, or damage resulting from:
Improper or unintended use of rented equipment;
Failure to follow manufacturer instructions or safety warnings;
Improper installation or assembly by the customer or another person;
Failure to properly supervise a child;
Use of equipment unsuitable for a child's age, height, or weight;
Unauthorized modification, repair, or alteration of equipment; or
Continued use of equipment after a defect or safety concern becomes apparent.
Nothing in this agreement is intended to exclude or limit any liability that cannot legally be excluded or limited under the laws applicable in the Turks and Caicos Islands.

7. LOSS, THEFT & DAMAGE
I accept responsibility for the rented equipment from the time it is delivered or collected until it is returned to The Baby Butler TCI.
I agree to return all equipment, accessories, and parts in substantially the same condition in which they were received, allowing for reasonable wear from normal use.
I may be responsible for reasonable repair or replacement costs if equipment is lost, stolen, intentionally damaged, negligently damaged, or returned with missing parts or accessories.

8. CLEANING
The Baby Butler TCI cleans and prepares rental equipment between customers.
I agree to return all equipment in reasonably clean condition. An additional cleaning fee may apply when an item requires cleaning beyond normal rental preparation due to excessive food, stains, sand, bodily fluids, smoke odor, or other excessive soiling.

9. CUSTOMER SAFETY CHECK
By signing this agreement, I confirm that before allowing a child to use the rented equipment, I will ensure that:
The equipment is appropriate for the child's age, height, weight, and developmental stage.
I have inspected the equipment and will immediately report any apparent damage, defect, or safety concern.
All straps, harnesses, brakes, locks, and safety mechanisms are properly secured and functioning.
I will follow all manufacturer instructions and safety warnings.
The child will receive appropriate adult supervision.
I understand my responsibilities regarding car-seat installation and use, if applicable.

10. ACKNOWLEDGEMENT & SIGNATURE
I confirm that I have read and understood this Baby Equipment Rental Agreement & Liability Waiver before signing it.
I understand that this agreement contains important terms regarding my responsibilities, the condition and use of rented equipment, safety requirements, and liability.
By signing below, I voluntarily agree to the terms and conditions of this agreement.
